Participation Terms and Conditions

By participating in Kasasa’s “These Are My People” promotion, the financial institution (“You”) agrees to be bound by these terms and conditions and the National Official Rules (collectively “Terms”). The National Promotion is subject to these Terms and to all applicable laws and regulations.

1. The National Promotion. Kasasa has organized the “These Are My People” national contest (“National Promotion”) whereby entrants submit a photo and statement in order to be considered for a national prize. You agree to participate and promote the National Promotion subject to these Terms located at kasasacontest.com. The National Promotion begins November 7th, 2022 at 12:00 A.M. CST and ends at 11 P.M. CST on December 18, 2022 CST (“Closing Date”). All times in this National Promotion refer to Central Standard Time (“CST”). All submissions must be received by Kasasa by the Closing Date or the entry will be automatically disqualified. You agree to submit all submissions You receive manually to Kasasa by the Closing Date. The National Promotion contest winners will be selected as stated in the National Official Rules.
1.1. National Promotion Materials. As consideration for your participation, Kasasa will provide You with access to a poster, audiovisual and/or other content (collectively “Licensed Content”) to promote the National Promotion. You agree: (i) to only use the Licensed Content to promote the National Promotion; (ii) that the License Content can only be used in your physical branch locations, on your officially owned and operated website(s) and/or your social media handle(s). You agree not to pay or provide any compensation or consideration to any social media platform for any additional or paid targeted promotion or distribution of the Licensed Content.; (iii) You can only use the Licensed Materials until February 1, 2023; and (iv) any other use of the Licensed Content requires express written approval from Kasasa and the National Promotion sponsors. You expressly acknowledge and agree to indemnity and hold harmless Kasasa for any and all Losses (defined below) caused by or arising out of any unauthorized use of the Licensed Content by You.

2. Use of Marks. You grant Kasasa the non-exclusive, non-transferable right and license to utilize your logos, trade names, service marks, trademarks, trade dress, copyrights, and other identifying marks provided by You in ("Marks") in any promotional materials and advertising in any media (print, broadcast, digital, mobile, or otherwise) ("Materials") in connection with the National Promotion. You acknowledge and agree that You will not use the name of the National Promotion or any trademark, service mark, logo, name, likeness, or any derivative thereof, or any other intellectual property belonging to Kasasa except in connection with the National Promotion or without the express written consent of Kasasa or the party to whom the property or right belongs.

3. National Promotion and Winner Complaints. In the event that anyone lodges a complaint or inquiry with You arising or relating to the National Promotion, You will inform Kasasa of any such complaint within two days of receipt of such complaint. Nothing in this provision derogates from Your obligation to indemnify Kasasa per these Terms. You are not responsible for dealing with customer complaints or inquiries concerning the conduct of the overall National Promotion, except to the extent the complaints or inquiries are related to your obligations hereunder. You shall notify Kasasa of any complaint or inquiry relating to the conduct of the overall National Promotion or relating to Kasasa within 2 days of receipt of such complaint.

4. Compliance with Law. You are responsible and liable for ensuring that You, your participation in the National Promotion, any and all marketing or disclaimers used by You are compliant with all applicable laws, regulations, ordinances, industry standards, and guidelines. Until all of your obligations have been satisfied, You have and shall maintain in effect all permissions, authorizations and consents that it needs to carry out its obligations under this Terms. Kasasa agrees to conduct the National Promotion in compliance with all applicable laws, regulations, and ordinances applicable to Kasasa.

5. Confidentiality. You and your affiliates, subsidiaries, successors, and assigns and their respective employees, agents, attorneys, and representatives shall maintain as confidential, and shall not use for their own purposes, or disclose or cause to be disclosed to any person or entity other than Kasasa all non-public, confidential, or proprietary information of Kasasa, including any proprietary information regarding the National Promotion or any other marketing or general business information, data (including the names, addresses, and other personally-identifiable information of the winners), documents, research, or procedures to which You may gain access in the course of its performance under this Terms. You shall not use winner names and other personally identifiable information for any reason unless expressly agreed otherwise in writing. Upon Kasasa's request, You shall promptly return all documents and other materials received from Kasasa. Kasasa shall be entitled to injunctive relief for any violation of this Section. This Section shall not apply to information that is: (a) in the public domain; (b) known to You at the time of disclosure; or (c) rightfully obtained by You on a non-confidential basis from a third party.

6. Representations and Warranties; Covenants; and Product Warranties. You and Kasasa each represent and warrant that they possess the full right, and corporate power and authority to enter into and fully perform its obligations as set forth herein. You further represent and warrant that the Marks, Kasasa's intended usage of the Marks will not violate, infringe, or misappropriate any third party's copyright, patent, trademark or other intellectual property or proprietary rights. You shall perform its obligations in a timely manner, understanding that time is of the essence in fulfilling such obligations.

7. Indemnification. You shall, at its expense, defend, indemnify, and hold harmless Kasasa and its subsidiaries, affiliates, successors, and assigns and their respective directors, officers, shareholders, and employees and Winners (collectively, "Kasasa Indemnitees") against any and all loss, injury, death, damage, liability, claim, deficiency, action, judgment, interest, award, penalty, fine, cost, or expense, including reasonable attorney and professional fees and costs, incurred by Kasasa Indemnitees relating to any claim by a third party or Kasasa arising out of or alleged to arise out of or occurring in connection with: (i) the use of the Marks in connection with the National Promotion as provided herein; or (ii) Your negligence, misconduct, or breach or alleged breach of this Terms. You shall not enter into any settlement without Kasasa's or Kasasa Indemnitee's prior written consent.

8. Limitation of Liability. You acknowledge and agrees that: (a) money damages at law are a fully adequate remedy to compensate You for any breach or threatened breach of this Terms by Kasasa; and (b) an action at law for money damages is your sole and exclusive remedy hereunder. You shall not have the right to seek equitable or injunctive relief to terminate this commitment, or in any way enjoin, restrain, or interfere with the development, conduct, or advertising of the National Promotion, or to obtain any other equitable relief. IN NO EVENT SHALL KASASA BE LIABLE TO YOU HEREUNDER FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. IN NO EVENT SHALL KASASA'S AGGREGATE LIABILITY RELATED TO THIS TERMS, WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED $500.

9. Survival. Subject to the limitations and other provisions of this Terms: (a) the representations and warranties of the parties contained herein shall survive the expiration or earlier termination of this Terms; and (b) any other provision that, in order to give proper effect to its intent, should survive such expiration or termination, shall survive the expiration or earlier termination of this Terms.

10. Assignment. You shall not assign, transfer, delegate, or subcontract any of your rights or obligations under this Terms without the prior written consent of Kasasa. Any purported assignment or delegation in violation of this Section is null and void.

11. Entire Terms/Governing Law. This document, including attachments and exhibits hereto and any documents incorporated by reference herein, constitutes the entire Terms and understanding between the parties regarding the subject matter hereof, and supersedes all prior discussions and all oral and written Terms between them relating thereto. No waiver, modification, or amendment to this Terms shall be valid unless in writing, signed by the parties hereto. No failure or delay by either party in exercising any right, power, or privilege hereunder shall operate as a waiver thereof, nor shall any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any right, power, or privilege. These Terms shall be governed by and construed in accordance with the substantive laws, but not the laws of conflicts, of the State of New York. Any legal suit, action, or proceeding relating to this Terms shall be instituted in the federal courts of the United States of America or the courts of the State of New York in each case located in the City of New York, New York, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, or proceeding.

Kasasa National These Are My People Contest, National Official Rules, November 7, 2022 – December 7, 2022

PRELIMINARY INFORMATION: NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR TRANSACTION DOES NOT INCREASE THE CHANCES OF WINNING. ENTRY IN THIS CONTEST CONSTITUTES ENTRANT’S ACCEPTANCE OF THE CONTEST’S NATIONAL OFFICIAL RULES. VOID WHERE PROHIBITED BY LAW. The These Are My People National Contest (“National Contest”) will begin on November 7, 2022 at 12:00 A.M. CST and end on December 7, 2022 at 11:59 P.M. CST (“National Contest Period”). All times in the National Contest refer to Central Standard Time (“CST”). National Contest is subject to all applicable federal, state and local laws.

ELIGIBILITY: Open only to permanent, legal United States residents who are physically residing in one (1) of the fifty (50) United States or the District of Columbia (excluding Puerto Rico, Guam, the Virgin Islands and other United States territories), and who are eighteen (18) years of age or older and of the age of majority in their state of residence as of the start of the National Contest Period. Officers, directors, and employees of National Contest Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the National Contest. National Contest Entities, (“National Contest Entities”) as referenced herein, shall include NBCUniversal Media, LLC, 30 Rockefeller Plaza, New York, NY 10112 and Kasasa LTD, 6504 Bridge Point Parkway Suite 500 Austin, TX 78730 (collectively, "National Sponsors") and each of their respective parent, subsidiary, and affiliate companies, and their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the National Contest.

TO ENTER: As part of your National Entry (defined below), you will be required to submit an original photo ("National Photo") and statement ("National Statement") on the following prompt: “Show and tell us about the special connection you have with your favorite person or people that mean the most to you and how you would use $25,000 together” (“National Prompt”). National Photo and National Statement may collectively be referred to herein as “National Submission” or “National Submissions.” National Submission must have been created by you. National Statement must be between fifty (50) and five hundred (500) words. National Statement must be original and submitted in the English language. If any minors appear in a National Submission, the entrant must be that minor’s parent and/or legal guardian. National Submission cannot have been created professionally. National Submissions with watermarks are not eligible. You must submit the National Submission according to the instructions provided on the applicable website. You must have the permission of any person who appears, or is identified or otherwise referred to, in your National Submission. To enter the National Contest, during the National Contest Period, utilize the QR code provided and/or the website at www.kasasacontest.com (the “National Website”) and follow the provided instructions to complete and thereafter submit the entry form, which includes the name(s) of your person/people, your full name, your email address, telephone number, zip code, and National Submission (the “National Entry”). If you choose to submit your National Entry via your web-enabled mobile device, data rates may apply. See your wireless service provider for details on rates and capabilities. All National Entries become the property of National Sponsors and will not be acknowledged or returned. You must submit the National Submission as part of your National Entry to enter the National Contest. By entering the National Contest, entrants grant National Sponsors the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit the National Submissions and to incorporate the National Submissions in other works in any and all markets and media worldwide in perpetuity. Entrants warrant that they have the sole and exclusive right to grant such rights to National Sponsors and that National Sponsors' reproduction, publishing, displaying, and/or other use of the National Submissions will not infringe on any rights of third parties, including, without limitation, copyright, trademark, privacy, or publicity, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract. If any National Submission contains material that is violent, pornographic, obscene, illegal, inappropriate, or racially or morally offensive or if any National Submissions do not comply with these National Official Rules or meet National Sponsors' standards for any reason, as determined by National Sponsors in their sole discretion, such National Submissions (and the related National Entries) may be rejected as ineligible for consideration. National Entries must comply with all applicable laws, rules, and regulations. National Sponsors shall have no obligation to copy, publish, display, or otherwise exploit the National Submissions. National Contest Entities may choose to broadcast on-air and/or display on the National Website a selection of National Submissions as determined by National Contest Entities in their sole discretion. By entering the National Contest, each entrant agrees to the posting of such entrant’s name and National Submission on the National Website and/or on National Contest Entities’ social media pages, including, but not limited to, Twitter, Instagram, LinkedIn, Tik Tok, and Facebook. Limit one (1) Entry per person during the National Contest Period. Multiple National Entries received from any person beyond this limit will void all such additional National Entries. National Entries generated by a script, macro, or other automated means or by any means that subverts the entry process will be disqualified. National Entries must be received before December 7, 2022 at 11:59 P.M. CST be eligible for the National Contest. National Sponsors' computer shall be the official timekeeper for all matters related to this National Contest. Entries that are incomplete, garbled, corrupted, fraudulent, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

SELECTION AND NOTIFICATION OF NATIONAL FINALISTS AND NATIONAL WINNERS: There will be two (2) rounds of judging: Round 1: Initial Judging to Determine the National Finalists; and Round 2: Judging to Determine the National Winners. Round 1: Initial Judging to Determine the National Runners Up and National Finalists: On or about December 9, 2022, one (1) or more qualified judges selected by National Sponsors (“ National Judges”) will review all eligible National Entries received during the National Contest Period and select up to fifteen (15) runners up (“National Runners Up”, each a “National Runner Up”), and five (5) potential finalists, (collectively, "National Finalists", each a “National Finalist”) based on the following judging criteria (“National Judging Criteria”): (1) National Statement (60%) – National Statement should address the National Prompt of the contest, be engaging with originality and clarity of expression and (2) National Photo (40%) – creativity, composition, and representation of National Prompt in the National Photo. The selection and review process may occur on a rolling basis as Entries are received. Each Finalist will advance to Round 2: Judging to Determine the National Winners, subject to verification of eligibility. The selection and review process may occur on a rolling basis as National Entries are received. In the event of a tie, the National Judges will break the tie by selecting the tied entrant(s) who received the highest points from the National Judges for the National Statement to advance to Round 2. In the event a tie remains, the tied entries will be judged by an additional tie-breaking judge, using the National Judging Criteria, to determine which of the tied entrants will advance to Round 2. National the right to pick fewer than fifteen (15) National Runners Up and five (5) National Finalists (or none at all) or to extend the National Contest Period if the National Contest does not receive a sufficient number of eligible and qualified National Entries, as determined by National Sponsors in their sole discretion. National Sponsors will make two (2) attempts to notify potential National Runners Up and National Finalists at the phone number and/or email address submitted at the time of National Entry. National Runners Up and National Finalists may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Round 1 National Contest Documents”) within two (2) days of such notification. Noncompliance within this time period will result in disqualification, and at National Sponsors' sole discretion an alternate potential National Runner Up or National Finalist may be selected from remaining eligible National Entries based on the National Judging Criteria. If any potential National Runner Up or National Finalist cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or does not satisfactorily execute and return all of the Round 1 National Contest Documents, such potential National Runner Up or National Finalist will be disqualified and time permitting, at National Sponsors' sole discretion, an alternate potential National Runner Up or National Finalist may be selected from the remaining eligible National Entries. Round 2: Judging to Determine the National Winners: On or about December 19, 2022, one (1) or more qualified Judges will review all eligible National Finalist Entries and select up to two (2) potential first prize winners (“National First Prize Winners”, each a “National First Prize Winner”) and one (1) potential grand prize winner (“National Grand Prize Winner”) based on the National Judging Criteria. In the event of a tie, ties will be broken as described in Round 1. National Finalists who are not selected as National First Prize Winners or the National Grand Prize Winner will still receive the National Runner Up Prize (defined below). National First Prize Winners and National Grand Prize Winners will be referred to collectively as “National Winners” or “National Winner” herein unless otherwise noted. Decisions of National Sponsors and National Judges are final and binding with respect to all matters related to the National Contest. Winning is subject to verification of eligibility. National Sponsors reserve the right to select fewer than two (2) National First Prize Winners and one (1) National Grand Prize Winner (or none at all) or to extend the National Contest Period if the National Contest does not receive a sufficient number of eligible and qualified National Entries, as determined by National Sponsors in their sole discretion. National Sponsors will make two (2) attempts to notify a potential National Winner at the phone number and/or email address submitted at the time of National Entry. National Sponsors may share each potential National Winner’s name and contact information with National Contest Entities and/or any prize supplier, as applicable, if necessary. Potential National Winner(s) may be required to execute and return the National Contest Documents within two (2) days of such notification. Noncompliance within this time period will result in disqualification, and, at National Sponsors' sole discretion alternate potential National Winners may be selected from the remaining eligible National Entries based on the National Judging Criteria. If any potential National Winner cannot be reached, is found to be ineligible, cannot or does not comply with these National Official Rules, or if National Contest Prizes (as defined below) or National Contest Prize notification is returned as undeliverable, such potential National Winner will be disqualified and time permitting, at National Sponsors' sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries. Limit one (1) Prize (defined below) per family or household, except that First Prize Winners and Grand Prize Winner may also receive the Runner Up Prize (defined below).

NATIONAL CONTEST PRIZES: There will be up to twenty-three (23) prizes awarded. National Runner Up Prize: Twenty (20) National Runner Up prizes (“National Runner Up Prizes”, each a “National Runner Up Prize”) will be awarded, one (1) each to the fifteen (15) National Runners Up and five (5) National Finalists, consisting of a one hundred dollar ($100) gift card. National First Prize: Two (2) first prizes (“National First Prizes”, each a “National First Prize”) will be awarded, one (1) each to the National First Prize Winners, consisting of a check for ten thousand dollars ($10,000). National Grand Prize: One (1) National Grand Prize will be awarded to the National Grand Prize Winner consisting of a check for twenty-five thousand dollars ($25,000). National Runner Up Prizes, National First Prizes, and National Grand Prize may collectively be referred to herein as “National Prize” or “National Prizes” unless otherwise noted. Estimated Retail Value (“ERV”) of each National Runner Up Prize is one hundred dollars ($100). ERV of each National First Prize is ten thousand dollars ($10,000). ERV of National Grand Prize is twenty-five thousand dollars ($25,000). Total ERV of all National Prizes is forty-seven thousand dollars ($47,000). Actual Retail Value (“ARV”) of National Prize may vary. Any difference between ERV and ARV will not be awarded. For any National Prize with a fair market value (“FMV”) of six hundred dollars ($600) or greater, National Sponsors will furnish an Internal Revenue Service Form 1099 to National Winner for the FMV of National Prize for the year in which National Prize was made available to National Winner. All details of National Prize will be determined in National Sponsors' sole discretion. National Sponsors reserve the right to substitute National Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of National Prize are the sole responsibility of National Winner. National Prize cannot be transferred by National Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of National Prize by National Winner. If National Prize is unclaimed within a reasonable time after notification from National Sponsors, as determined in National Sponsors' sole discretion, it will be forfeited, and time permitting, an alternate National Winner may be selected from the remaining eligible National Entries at National Sponsors' sole discretion.

CONDITIONS: By entering the National Contest, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless National Contest Entities each of their respective officers, directors, agents, and employees (collectively, “National Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the National Contest and/or entrant’s acceptance, possession, use, or misuse of National Prize or any portion thereof (including any travel related thereto); (b) to indemnify National Released Parties from any and all liability resulting or arising from the National Contest and to hereby acknowledge that National Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to National Prize, including express warranties provided exclusively by prize supplier and/or Prize Provider that are sent along with National Prize; (c) if selected as a National Finalist and/or National Winner, to the posting of such entrant’s name and/or social media username, on the National Website and the use by National Released Parties of such name, social media username, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these National Official Rules and to waive any right to claim any ambiguity or error therein or in the National Contest itself, and to be bound by all decisions of the National Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the National Contest at National Sponsors' sole discretion.

ADDITIONAL TERMS: National Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these National Official Rules. Any attempt to deliberately damage the National Contest or the operation thereof is unlawful and subject to legal action by National Sponsors, who may seek damages to the fullest extent permitted by law. The failure of National Sponsors to comply with any provision of these National Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of National Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these National Official Rules. National Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the National Contest. National Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of National Entry information; for errors in any promotional or marketing materials or in these National Official Rules; for any human or electronic error; or for National Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. National Sponsors reserve the right to cancel, modify, or suspend the National Contest or any element thereof (including, without limitation, these National Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these National Official Rules). In the event of cancellation, modification, or suspension, National Sponsors reserve the right to select National Winners in a random drawing from among all eligible, non-suspect National Entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted on the National Website. National Sponsors may prohibit any National Entrant or potential entrant from participating in the National Contest, if such National Entrant or potential entrant shows a disregard for these National Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other National Entrant, National Sponsors, or National Sponsors' agents or representatives; or behaves in any other disruptive manner (as determined in National Sponsors' sole discretion). National Sponsors reserve the right to modify these National Official Rules for clarification purposes without materially affecting the terms and conditions of the National Contest.

DISPUTES: THE NATIONAL CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK, NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
